ALTA title insurance remains an excellent solution for complex transactions, high-balance loans exceeding AOLPro’s $1.25 million limit, properties with complicated title histories, and transactions that do not qualify for alternative title products.
AOLPro: A Lower-Cost Alternative
An attorney opinion letter (AOL) is a legal opinion issued by a licensed real estate attorney confirming that title is clear and that the lender’s mortgage will be in the proper lien position after closing. The attorney performs the same public records review conducted during a traditional title examination.
AOLPro is an insured attorney opinion letter platform that provides a GSE-approved alternative to traditional title insurance. It is accepted by Fannie Mae and Freddie Mac, backed by A.M. Best A-rated insurance carriers, available in all 50 states, and eligible for loans up to $1.25 million.
The savings can be substantial:

GSE Title Waiver: Available for Eligible Conventional Refinances
The GSE Title Waiver is offered under the GSEs’ title modernization programs, developed with the FHFA. For eligible low-risk conventional refinances, these programs allow lenders to rely on an automated title review rather than traditional title insurance.
According to the FHFA, eligible borrowers may save between $500 and $1,500 per transaction.
The program is available only for qualifying conventional refinance loans and is not available for:

Lender’s Coverage vs. Owner’s Coverage
Every financed transaction requires protection for the lender, whether through a traditional lender’s title insurance policy or an approved alternative such as AOLPro.
A lender’s policy protects the lender’s interest in the property up to the outstanding loan balance and remains in effect until the loan is paid off, refinanced, or otherwise satisfied.

On a purchase transaction, both lender’s and owner’s coverage are typically issued together, often at a discounted simultaneous issue rate. On a refinance, the existing owner’s policy generally remains in place, and only the lender’s coverage is replaced.

Settlement Fees, Search Fees, and Endorsements

Recording fees, transfer taxes, and other government charges are excluded because they apply regardless of which title solution you select.

Who Qualifies GSE Title Waiver?
The GSE Title Waiver is available on eligible GSE-backed conventional refinance loans. It is not available for:
- Purchase transactions
- FHA, VA, or USDA loans
